Complying with Nevada Law


In Nevada, privacy laws governing pre-employment background checks are particularly strict, and employers must comply with NRS Chapter 613 and other applicable statutes. Under NRS 613.570, the use of credit reports in hiring is restricted to positions that involve handling money, accessing confidential information, or where such checks are required by law. NRS 179.245 prohibits employers from requesting or using sealed or expunged criminal records in employment decisions. Additionally, NRS 613.135 protects applicants’ digital privacy by barring employers from requesting access to personal social media accounts or login credentials. For public employers, NRS 613.330 through 613.335 requires that inquiries into criminal history be delayed until later stages of the hiring process, and all employers must ensure that any criminal conviction considered is directly related to the responsibilities of the position. In highly regulated industries such as childcare, healthcare, education, and gaming, more stringent background requirements may apply.     There are, however, numerous reliable databases that provide information about a person's Criminal History. These databases are not available to the general public. They are proprietary and are utilized by Law Enforcement agencies, Insurance companies, and Private Investigators to discover a person's true criminal history. But sometimes, even that is not enough.
